General Terms and Conditions of Sale

These General Terms and Conditions of Sale and Use are on one part by:

  • The French company registered with the Business and Establishment Directory of France (SIRENE) under number 877 832 337, operating under the name Zoé Leber and domiciled in Douarnenez (29100), hereinafter referred to as ‘Zephy’, owner and manager of the website zephy.fr and its digital products (online drawing courses and downloadable ebooks).

and on the other part by:

  • any individual or legal entity wishing to make a purchase through the Zephy website, hereinafter referred to as the ‘Buyer’ or ‘Customer’.

1. Purpose and Scope

These terms of sale aim to define the contractual relationships between Zephy and the client and the conditions applicable to any purchase made through the website zephy.fr.

 

We invite all users to carefully read these General Terms and Conditions of Sale and Use (GTCSU) before using the website zephy.fr and before purchasing its digital products. Any use of the aforementioned site and any order placed implies an unconditional acceptance of these GTCSU.

 

These GTCSU apply to all transactions concluded through the website zephy.fr. All new features of the site or any new products and services added after the drafting of these GTCSU will be subject to them.

 

Zephy retains the possibility to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in effect on the date of the order by the buyer.

 

By registering on this site, accessing, or using it in any other way, you hereby agree to be bound by the terms and conditions stated below. The mere use of this website implies knowledge and acceptance of these general conditions. In certain specific cases, we may also ask for your explicit agreement.

2. Intellectual Property

We or our licensors own and control all copyright and other intellectual property rights on the website and the data, information, and other resources displayed or accessible on the website.

 

All digital products offered by Zephy are intended for private individual use only. They are all intellectual property of Zephy. You are authorized to download, print, and save purchased resources for your personal and non-commercial use.

 

The use of our digital products for any illegal or unauthorized purpose is prohibited. Any total or partial reproduction or distribution of Zephy’s digital products to third parties is prohibited. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the digital products.

 

The elements of the zephy.fr website are also the intellectual and exclusive property of Zephy. No transfer of intellectual property rights is made through these terms and conditions.

 

Any use outside the scope defined in these terms and conditions constitutes an act of counterfeiting, which exposes the user to legal action. By posting their drawings and statements on the zephy.fr website and on the dedicated Discord server for training, the client agrees to potentially have them displayed for advertising purposes, in order to promote the various courses produced by Zephy.

3. Digital Products and Orders

The digital products and services offered are those displayed on the zephy.fr website. Each product has its complete description presenting all the specific contents it offers. We reserve the right to modify the description at any time without prior notice, or to discontinue offering a product for sale.

The customer follows a specific series of steps to place an order:

 

 

  • They have access to the product characteristics on the dedicated sales page.
  • They choose their product (individual or in a bundled offer).
  • They are invited to create their account by providing essential information (First Name, Last Name, email address, and password).
  • They have a summary of the order (with a list of all the contents) before making payment.
  • They are prompted to proceed with payment by Credit Card or PayPal to obtain the product.
  • They immediately receive access to their product in their newly created personal account.

The customer will then receive an email confirmation of the order validation and access to the product. They will receive an invoice related to their order from Stripe or PayPal.

 

The customer agrees to provide accurate and complete order and account information for any order placed. They commit to keeping their email address up to date so that we can contact them if necessary.

4. Price and Payment

The prices are indicated in euros (€) all taxes included (VAT). The price of products may be changed at any time without notice. However, the rate applied to an order will be the one announced at the time of the order.

 

Payment is due immediately on the date of the order, including for pre-order products. Payment can be made by Credit Card via a secure connection through Stripe, or by PayPal. The transmitted information is encrypted and cannot be read during transport over the network. Any guarantee regarding the security of this system is entirely the responsibility of the company Stripe and cannot be attributed to us.

 

Confirmation of an order implies acceptance of these terms of sale. All data provided and the recorded confirmation will be proof of the transaction. The customer will receive an invoice through Stripe or PayPal.

5. Access to the Courses

Access to the courses is provided through the Thrivecart Learn platform, which hosts all video lessons and downloadable files. Immediately after placing your order, you will receive an email with access to your personal account. Please make sure to keep this email private and secure in order to access your courses.

6. Right of Withdrawal and Refund Conditions

Pursuant to Article L121-20 of the French Consumer Code, ‘the consumer has a period of fourteen clear days to exercise their right of withdrawal without having to justify reasons or pay penalties, except, where applicable, return shipping costs.’ ‘The period mentioned in the preceding paragraph runs from the receipt of the goods or acceptance of the offer for services.’

 

If a product does not meet your expectations, you can contact us within 14 days from the date of purchase at the following address: hey@zephy.fr, with a simple refund request along with your invoice number.

 

If you exercise your right of withdrawal, we will refund the payment received from you without undue delay and in any event no later than 14 days from the day we are informed of your decision to cancel your purchase. We will make this refund using the same means of payment as you used for the initial transaction; you will not incur any fees as a result of this refund.

7. Limitations of Liability

Zephy shall not be held responsible for any potential compatibility issues between a digital product and an electronic device. It shall not be held liable for the unavailability, whether temporary or permanent, of access to the Thrivecart course platform. Although Zephy makes every effort to ensure continuous service, there may be interruptions at any time.

 

Zephy reserves the right to render the zephy.fr website unavailable in order to carry out any updates, improvements, or maintenance operations. In the online sales process, Zephy is only bound by an obligation of means. Its liability shall not be incurred for damages resulting from the use of the Internet network, such as data loss, viruses or hacking, service disruption, or other unintentional problems.

8. Personal Data Protection

Zephy is committed to preserving the confidentiality of the information provided by the buyer, which may be transmitted for the use of certain services: see the privacy policy.
 

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access and rectify personal data concerning you. By agreeing to these General Terms and Conditions of Sale, you acknowledge that you have read our privacy policy and consent to the collection and use of this data.

 

By entering your email address on the website, you will receive emails containing information and/or promotional offers regarding products published by Zephy. You can unsubscribe at any time. To do so, simply click on the “Unsubscribe” link at the end of our emails.

9. Force majeure

The performance of Zephy’s obligations under these terms is suspended in the event of an unforeseen event or force majeure that would prevent its execution. Zephy will notify the client of the occurrence of such an event as soon as possible.

10. Dispute Resolution

All clauses contained in these general terms and conditions of sale, as well as all purchase and sale transactions referred to therein, shall be subject to French law.
